Board of Supervisors Work Session

Minutes of May 14, 2012

Call to Order: Chairman Gallagher called the meeting to order at 7:33 P.M.

Nightmares of Newtown, LLC, 74 Newtown-Richboro Road

Mr. Brian Tomlinson advised the Supervisors the he is proposing a haunted house at the property located at 74 Newtown-Richboro Road. He reported that there would be no changes to the outside of the building.

Chairman Gallagher reported that he has been in contact with the American Legion and that they support what Mr. Tomlinson is proposing. He is trying to contact Monsignor Picard from St. Andrew's Church to see if they have any objections to what is being proposed.

Supervisor Ciervo requested Mr. Brian Tomlinson to explain in more detail what is being proposed and if he owns the property. Mr. Tomlinson advised that he owns the property being discussed, lives on the property next door and that the property being discussed has been vacant since October, 2011. The property is approximately 2.75 acres. He is proposing a haunted house. Patrons would enter from Newtown-Richboro Road and exit thru the Legion property onto Linden Avenue. The driveway would be stoned. 104 parking spaces are being proposed on the grass. The trailer on the property would be removed.

Supervisor Ciervo inquired on the applicants experience running a haunted house and the large volume of vehicles parking. Mrs. Danielle Tomlinson reported on her experience with regards to running haunted houses and advised that there would be people running the parking.

Supervisor Ciervo inquired on the use of police or security with regards to parking and traffic. Mrs. Danielle Tomlinson reported that there would be people overseeing the parking.

Supervisor Ciervo advised that he has concerns with regards to traffic congestion on Newtown-Richboro Road.

Mr. James Tomlinson reported that they are unsure of the number of people who will be attending the haunted house and that they have been in touch with the Police Department with regards to traffic.

Supervisor Ciervo suggested having the entrance off of Linden Avenue. Mr. Brian Tomlinson advised that is a possibility but could cause additional problems with regards to German Avenue. He commented on a neighbor blocking traffic on German Avenue. He also reported that his property is adjacent to German Avenue and that it would be ideal to enter/exit off of German Avenue.

The Supervisors discussed the right-of-way off of German Avenue. Mrs. Fountain reported that the plan shows that the applicant owns enough property to have a driveway in that area. Mr. Brian Tomlinson commented on a neighbor not wanting German Avenue used.

Mrs. Fountain commented on the vacation of German Avenue and the rights.

The Supervisors agreed that an alternate entrance should investigated.

Mrs. Fountain reported that the use is a concern. She updated the Supervisors on her meeting with Ed Murphy and Joe Czajkowski. It was suggested that E-9 use would fit best with what is being proposed but E-9 use is not allowed in the CC District. A variance or special exception would be needed.

Mr. Torrente also reported that the E-9 use is not permitted in the CC District and that a variance would be needed. He questioned if the building is being used for residential. Mr. Brian Tomlinson reported that the house is currently vacant.

Supervisor Ciervo inquired on how the parking calculations were determined. Mrs. Fountain advised on the square footage of the existing house and that the applicant is proposing more spaces than required by the zoning.

Supervisor Ciervo suggested the primary entrance be off of German Avenue verses Newtown-Richboro Road.

Mrs. Fountain reported that a variance would be needed for stoning the driveway off of the existing paved driveway. She noted that the driveway would need to be at least 25 ft. not to require a variance.

Mrs. Fountain advised that the surveyor should do deed and property research for all of the surrounding properties. Mr. Brian Tomlinson advised that has already been done. Mrs. Fountain reported that information should be shown on the plan.

Supervisor Ciervo inquired on the hours of operation. Mrs. Danielle Tomlinson reported that the hours would be Thursday thru Sunday from 6:30 P.M. to 10 P.M. for 21 days in the fall.

Chairman Gallagher commented on Mr. Murphy knowing the next steps in the approval process.

The Board agreed that they are okay with the proposed sketch plan, but that they would like the access to be from German Avenue.

Mr. Murphy reported that he would file an application with the Zoning Hearing Board.

Supervisor Gallagher advised that he supports the plan, but is concerned with the event being too large for the property and how to proceed in future years. The Supervisors discussed Supervisor Gallagher's concerns and suggested something be written into the variance.

The Supervisors thanked the applicants for their time.

Supervisor Ciervo commented on the Fire Protection Fund being separate for the General Fund and that the money should not be co-mingled. He suggested that the matter be discussed with the new Township Manager.

Supervisor Ciervo commented on the Newtown Corporation. He would like a report on their activities and for them to make a presentation at a work session. He advised that according to their Bylaws an annual report should be presented to the Township and Borough.


Without objection, the meeting was adjourned at 8:05 P.M.

Chairman Gallagher advised that once the meeting adjourned the Supervisors would be meeting in Executive Session. He also advised that the Supervisors met in Executive Session on May 9, 2012.
