Newtown Area Joint Zoning Council
Meeting of June 7, 2012
A meeting of the Newtown Area Joint Zoning Council was held on Thursday, June 7, 2012 in the Meeting Room of the Wrightstown Township Municipal Building, 2203 Second Street Pike, Wrightstown, PA. Members in attendance were Chester S. Pogonowski and Jane B. Magne representing the Wrightstown Township Board of Supervisors, Dan Rattigan and Walt Wydro, representing the Upper Makefield Township Board of Supervisors and Planning Commission, respectively, Rob Ciervo and Allen Fidler representing the Newtown Township Board of Supervisors and Planning Commission, respectively, Terry Clemons representing the law firm of Clemons, Richter & Reiss, P.C., and Lynn Bush, Executive Director of the Bucks County Planning Commission.
Chairman Pogonowski called the meeting to order at 7:30 P.M.
On motion of member Magne, seconded by member Rattigan minutes of the meeting held on February 2, 2012 were approved. All voted in favor. Note: Auditors for the 2012 Treasurer’s records will be the Wrightstown Township Elected Auditors which will be inserted in the above minutes.
TREASURER’S REPORT: In the absence of Treasurer Michael Gallagher, chair Pogonowski reported that an account balance of $1,314.42 was shown as of June 6, 2012. On motion of member Rattigan, seconded by member Magne the Treasurer will be directed to mail notices to each of the three townships. He will be advised to calculate new assessment amounts using the 2010 census figures for each Township and invoice appropriately.
Ms. Bush will verify three corrections to be made in the next printing of the Zoning Ordinance and notify the Publisher. Solicitor Clemons will develop an appropriate Amendment which will verify any omissions or errors in a document. It was decided that the document will be circulated to the Planning Commissions and Boards of Supervisors for approval which will be returned to Solicitor Clemons who will be authorized to advertise the Amendment. On motion of member Rattigan, seconded by member Magne, the action was approved. The cost of the publication/zoning ordinance will be $40.
Ms. Bush reported having attended the meeting of the Joint Planning Commission meeting on March 1, 2012 where discussions centered on the proposed ‘drive-through’ ordinance; solar and wood-fired boilers ordinances. Following editorializing proposals for the Solar and Wood-fired Ordinances by Ms. Bush and Solicitor Clemons for spelling errors, etc., an advertisement for consideration of adoption of these three at the August meeting of the Council was authorized. A motion approving such action was made by member Ciervo, seconded by member Rattigan and approved by all members attending.
Lingering Ordinances: It was noted that two proposed ordinance/amendments are future agenda items: Drive-through regulations and Adult Businesses.
Solicitor Clemons circulated a proposed ordinance/amendment entitled: “ An Ordinance of the Township of Wrightstown, Bucks County, PA., to Manage its Rights of Way; Establishing a Rental Fee; Requiring Insurance and Indemnification; and Creating Mechanisms for Enforcement.” Members of Boards of Supervisors were asked to review the document and present comments/concerns at the August meeting of the Council. A brief discussion followed relating to Conditional Use Approval and limitations on the matters of rights-of-way.
Chairman Pogonowski noted that there would be no scheduled meeting of the Council in July and the next meeting would be on August 2, 2012 beginning at 7:30 P.M. in the Meeting Room of the Wrightstown Township Municipal Building.
There being no further business to come before the Council. The meeting was duly adjourned.
