MINUTES OF JUNE 7, 2006: James Bowe moved to approve the minutes of June 7, 2006. The motion was seconded by Robert Hafner and passed unanimously.


Members Present: James Manahan, Chairman; James Bowe, Member; Robert Hafner, Member and Harry Stevens, Member Representing Newtown Township; Patrick Foster, Vice-Chairman Representing Newtown Borough. Not present were Barbara Jankowski, Member and Jerry Schenkman, Liaison Representing Newtown Township and Don Smith, Liaison Representing Newtown Borough.

Not present was Brian Jeter, Director of Government & Community Relations representing Comcast Cable Communications, Inc.

CALL TO ORDER:

Chairman James Manahan called the meeting to order at 7:35 P.M.

MINUTES OF APRIL 5, 2006:

James Bowe moved to approve the minutes of April 5, 2006. The motion was seconded by Patrick Foster and passed unanimously (5-0).

MINUTES OF MAY 3, 2006:

Patrick Foster moved to approve the minutes of May 3, 2006. The motion was seconded by Robert Hafner and passed unanimously (5-0).

NEW BUSINESS:

Verizon Newtown Crossing

James Manahan updated the Committee members with regards to Verizon damaging landscaping along a roadway in Newtown Crossing. He advised that per Barbara Jankowski the situation with regards to Verizon has been resolved.

Child Predator Content

James Manahan advised the Committee members on an email he received from former Committee member Walter Iwaskiw with regards to child predators. The members discussed the possibility of showing the content on Channel 22. The Committee members agreed to endorse the concept in the next report to the Board of Supervisors.

The Committee members discussed who is providing the content.

Summer Recess

The Committee members agreed to cancel the July 5, 2006 meeting.

OLD BUSINESS:

Franchise Agreement Appendix for Township and Borough

James Manahan thanked Harry Stevens for his work with regards to the Township/Borough PEG Channels.

Verizon Discussions

The Committee members discussed Verizon with regards to how they are repairing damages to properties within the community.

Patrick Foster advised the Committee members on the number of one calls the Water Company is receiving due to Verizon working within the community. He also commented with regards to damaged gas lines hit by Verizon.

The Committee members discussed the recent electrical outages within the community.

The Committee members agreed to advise the Board of Supervisors on their concerns with regards to the condition Verizon is leaving the lawns within the community.

James Manahan advised the Committee members that Barbara Jankowski asked Dan Reavey to attend a Committee meeting and that Dan Reavey has agreed to attend the September meeting.

James Bowe suggested inviting the Verizon representatives that are in charge of the installation to a meeting.

Verizon Franchise Agreement

The Committee members discussed the upcoming meeting on June 20, 2006, to discuss the Verizon Franchise Agreement.

Harry Stevens updated the Committee members on what information he had with regards to the Verizon Franchise Agreement.

The Committee members discussed the right-of-way Ordinance.

Harry Stevens advised the members on his feelings with regards to the Verizon Franchise Agreement.

The Committee members discussed State and Nation Franchising.

Robert Hafner advised the members on his feelings with regards to State Franchising.

The Committee members discussed the Montgomery County Consortium with regards to a Verizon Franchise Agreement.

The Committee members discussed the negotiating changes to the proposed Verizon Franchise Agreement.

The Committee members discussed the possible hold ups to signing the agreement (wording of agreement, no leader of Consortium, Verizon unwilling to make a lot of changes to agreement, loss of authority to Municipalities).

Harry Stevens advised the Committee members on discussions with Fred Polner, Esquire.

James Bowe commented with regards to IP traffic, what will happen to the Franchise Fees, the loss of fees on Internet Service and control of the right of way.

Harry Stevens advised the Committee members that Verizon has pledged to keep Franchise Fees intact.

Colleges & Universities Programming Content

James Manahan updated the new Committee members with regards to the local Colleges and Universities providing content for Channel 78.

COMCAST UPDATE:

The Committee members discussed the email received from Brian Jeter.

The meeting adjourned at 8:13 P.M.

The next meeting is scheduled for August 2, 2006. The meeting will begin at 7:30 P.M., in the Newtown Borough Fire Station located at 14 Liberty Street, Newtown.
