ZONING HEARING BOARD

MINUTES OF THE MEETING OF MARCH 6, 2008

The Newtown Township Zoning Hearing Board met on Thursday, March 6, 2008 in the Newtown Township Building. In attendance and voting were: John Lenihan, Chairman; Victoria Bowe, Vice Chairman; David Katz, Secretary; Karen Doorley and William Wall member. Also in attendance were: James J. Auchinleck, Jr., Esq., Solicitor and Michael Solomon, Zoning Officer.

Call to Order

Mr. Lenihan called the meeting to Order at 7:30 PM.

The Pledge of Allegiance

Approval of Minutes

Mr. Katz moved to accept the minutes of January February 7, 2008. Mrs. Bowe seconded and the motion passed 4-0-1, with Mrs. Doorley abstaining.

The agenda was reviewed:

  • Application of Prestige Community Bank – 104 Pheasant Run
  • Application of Crossing Community Church – 80 Lower Silver Lake Road
  • Application of Lodestar Investments – 759 Newtown Yardley Road

 

Application of Crossing Community Church

Mr. Katz read into the record the application of Crossing Community Church, owner, requesting a Special Exception under Section 501(A)(3) of the Joint Municipal Zoning Ordinance of 1983 to permit a C-3 commercial school. The subject property is 80 Lower Lake Road, Newtown, in the OR Office Research Zoning District, being further known as Tax Map Parcel ## 29-10-73, 29-10-42-2, 29-10-42-3, 29-10-242-6.

Mr. Auchinleck informed the Board that he had received correspondence from Joseph Caracappa, attorney for the applicant, requesting that the application be continued to the June meeting.

Mr. Wall moved to continue the application of Crossing Community Church to June 5, 2008. Mrs. Bowe seconded and the motion passed unanimously.

Application of Lodestar Investments

Mr. Katz read into the record the application of Lodestar Investments, owner, requesting variances from Sections 405(B)&(C) of the Joint Municipal Zoning Ordinance of 1983 to permit construction of a dwelling on an 18,174 sq ft lot with 13,198 sq ft lot area where 30,000 sq ft is required, a 27% impervious surface with 13% is permitted, an 83 ft lot width with 100 ft required, and a 40 ft aggregate side yard with 50 ft required and a Special Exception under Section 1208(C)(2) to permit construction on a non-conforming lot. The subject property is 759 Newtown Yardley Road, Newtown, in the R-2 High Density Residential Zoning District, being further known as Tax Map Parcel #29-10-53

Mr. Auchinleck informed the Board that he had received correspondence from Charles O. Marte, attorney for the applicant, requesting that the application be continued to the April hearing.

Mr. Wall moved to continue the application of Lodestar Investments to April 3, 2008. Mr. Katz seconded and the motion passed unanimously.

Application of Prestige Community Bank

Mr. Katz read into the record the application of Prestige Community Bank, Cameron C. Troilo Inc., owner, requesting a variance from Section 1106(H)(4)(a) of the Joint Municipal Zoning Ordinance of 1983 to permit a 20 sq. ft. wall-mounted sign in addition to existing monument sign exceeding the maximum number of signs. The subject property is 104 Pheasant Run Road, Newtown, in the LI Light Industrial Zoning District, being further known as Tax Map Parcel #29-10-144.

Jeff Carson of City Sign Service was in attendance representing the applicant.

Mr. Lenihan asked if anyone present wished to be party to this application. There was no response.

Mrs. Doorley recused herself from the proceedings as she has business ties to the applicant.

Mr. Auchinleck explained to the applicant that due to the recent death of the owner of the stenographer’s business, there has been a mistake in scheduling a stenographer for this evening’s hearing. The applicant has a right to a stenographer, and could request that the application be continued, as no transcript of the proceedings would be available. If the applicant proceeds, the recording secretary will provide minutes as the only record of the hearing.

Mr. Carson agreed to proceed with the hearing. He explained that the Bank is a new business in this area and is occupying space in a new building at Terry Drive in the Newtown Business Commons. The Bank’s location is at the far end of the building, away from the corner and is not visible from the intersection The drive-through window is not visible from the intersection. The Bank would like to place an additional sign, as shown in the application, along the wall, adjacent to the front entrance to the Bank, to make the location identifiable from the street. The largest letter is 10 inches; the smaller letters are 4 inches high. The letters will be mounted to the wall of the building and there will be no illumination.

Mr. Solomon had no comment.

Mr. Katz moved to grant a variance from Section 1106(H)(4)(a) of the Joint Municipal Zoning Ordinance of 1983 to permit a 20 sq. ft. wall-mounted sign in addition to existing monument sign exceeding the maximum number of signs. Mr. Wall seconded and the motion passed 4-0.

Other Business

Mr. Auchinleck updated the Board on the Stuckley, et al mandamus action.

Mrs. Bowe moved to adjourn at 8:40 PM. Mr. Wall seconded and the motion passed unanimously.
